Arkansas State could sue Miami Hurricanes over lost game

According to the Law Firm Venable LLC, the Majeure Clause is :

"“(French for “superior force”) A contract provision that relieves the parties from performing their contractual obligations when certain circumstances beyond their control arise, making performance inadvisable, commercially impracticable, illegal, or impossible"

At the time of the Hurricane, several Arkansas news outlets ridiculously blasted the Miami football team and athletic department of being afraid to play in Jonesboro and against the Redwolves.

KAIT obtained a letter from the Arkansas State Athletic department regarding their intentions for a lawsuit. The entire letter was posted as a Google Doc on the KAIT website. The Miami response was released through an anonymous source on the website Scribd.

"“Unless Miami changes course on or before February 15, 2018, we will begin the process of filing a lawsuit against the University of Miami in the appropriate Arkansas state court.”"

Arkansas State System General Counsel Brad Phelps also released a statement that said:

"“It is very unfortunate that we have been unable to resolve this matter, and we remain hopeful this can be worked out without the need for litigation. Ultimately that will be up to the University of Miami.”"

The letter was sent from Phelps to University of Miami Assistant General Counsel James Rowlee according to CBS Sports. Arkansas State is upset that they lost the home game against the Hurricanes according to CBS Sports. CBS also reported that the February 15th date was reached after talks between Miami and Arkansas State broke down.
